Temporary suspension of import, re-export, and transit of waste categories

Circular No. 18/2024/TT-BCT stipulates the temporary suspension of the import, re-export, and transit of waste categories for the purpose of enhancing the management of waste import activities and preventing commercial fraud.

According to the Ministry of Industry and Trade, on November 15, 2019, Circular No. 27/2019/TT-BCT was issued to regulate the temporary suspension of import, re-export, and transit of waste categories (replacing Circular No. 41/2018/TT-BCT). As stipulated in Article 1, Circular No. 27/2019/TT-BCT is effective until December 31, 2024.

After over 4 years of implementation, the Ministry of Industry and Trade has conducted an evaluation of the enforcement of Circular No. 27/2019/TT-BCT regarding the temporary suspension of import, re-export, and transit of waste categories.

To avoid legal gaps when Circular No. 27/2019/TT-BCT expires, on October 8, the Ministry of Industry and Trade issued Circular No. 18/2024/TT-BCT regulating the temporary suspension of import, re-export, and transit of waste categories. It also aims to continue policies to strengthen the management of waste import activities, prevent congestion at ports, and curb the emergence of commercial fraud and smuggling into the domestic market of environmentally polluting waste in the context of tightening waste import regulations in the region, applying trade defense measures, and closely controlling long-distance waste imports to minimize environmental pollution risks.

Circular No. 18/2024/TT-BCT specifies the categories of waste temporarily suspended from import, re-export, and transit (the waste categories specified in the Appendix accompanied by Circular No. 18/2024/TT-BCT do not apply to cases of transit trade where goods are transported directly from the exporting country to the importing country without passing through Vietnamese borders).

This circular applies to traders engaged in temporary import, re-export, and transit of goods; organizations, agencies managing temporary import, re-export, and transit activities; and other relevant entities involved in temporary import, re-export, and transit of goods.

Circular No. 18/2024/TT-BCT is effective from January 1, 2025, until December 31, 2029.
